OFFICIAL RULES AND REGULATIONS ELIGIBILITY
You must be 18 years of age or older to donate and participate in the GFGCF Drawing.
Only one (1) individual may be identified as the donor for the Drawing entry.
All federal, state and local laws and regulations apply. Void where prohibited. Entries will be made by donations and only via the Internet.
All donations are non refundable per IRS rules.
All communications, including the email ticket confirmation, will be sent to the email address supplied during the donation process.
It is the donor's responsibility to provide a valid, deliverable mailing address and email address to: Gift From God Computer Foundation 120 N. Central Ave. Oviedo Fl 32765. GFGCF and its agents, Board, vendors, volunteers and members assume no liability for lost, late, misdirected, mutilated, incomplete, illegible, undelivered entries or entries without proper payment received, which entries shall be deemed invalid and shall be immediately disqualified.
GFGCF volunteers and Board members are not eligible to participate in this Drawing.
GFGCF’s decision shall be final. GFGCF may at any time modify, revise, or update the Official Rules to correct any errors, omissions or changes to the Drawing, in its sole discretion.
By entering the Drawing, the donor acknowledges that he or she is aware of and is bound by all of the official Drawing rules.
COST
Each entry is $5.00. You can get 3 entries for $10.00. Each entry is non refundable.
DRAWINGS
A maximum/minimum of 6,000 entries will be sold for the Drawing. All entries must be received by 11:59 p.m. EST on August 30, 2010 to be eligible for this drawing. Drawing takes place on August 31, 2010. Should all 6,000 entries not be sold GFGCF reserves the right to extend the Drawing one month at a time. GFGCF will notify you via email and the GFGCF website, should an extension be necessary.
PRIZES
The Grand Prize winner ("GPW") is entitled to the Jet Ski or Cash value of US $8,000 (eight thousand US dollars). Within 30 days of notification by GFGCF may select the cash alternative by providing GFGCF with e-mail notification of their selection of either: (i) the payment of the $8,000.00 cash prize will be made within thirty (30) days following GFGCF receipt of GPW's notification of acceptance of this option. (ii) If the Jet Ski is selected, then the GPW will be informed as soon as arrangements are made with the dealer. GPW must then supply GFGCF with any and all requested documentation. Jet Ski comes factory equipped and GPW is solely responsible for any and all shipping and handling costs and state or local license, title, registration, taxes, or fees associated with the vehicle, as well as insurance (proof of which must be shown prior to possession) and pickup or delivery costs at the dealership as well as any non-standard options chosen by the winner and negotiated with the dealership. The vehicle is delivered F.O.B. Location. Prizes may not be exactly as shown, are based on manufacturer availability and may be substituted with a prize of similar value. The approximate value of the jet-ski is over $10,000.00 (manufacturer's suggested retail price) and is based on estimated MSRP pricing at the time of prize selection. The odds of winning a prize are dependent upon the number of valid entries received, but shall be no less than 1-in-6000. The statement of 1-in-6,000 chance to win a prize is based on the donation of a single ticket, 6,000 total tickets being issued. In the event of a winning entry having more than one name, GFGCF will award the prize to the first name listed on the entry. Records of GFGCF shall be deemed correct if there is any discrepancy. GFGCF is not responsible for resolving any disputes that may arise from different individuals listed on a Drawing certificate. With proper transfer documents bearing notarized signatures, as required by the Drawing, a prize may be transferred. Winners are responsible for all shipping and handling costs.
NOTIFICATION OF WINNERS
All winners will be notified via e-mail or by phone of the prize won and any requisite procedures to claim the prize. The winner will be required to pay shipping charges on all prizes. In California, the winner may also be charged a state mandated disposal fee. Only the winner’s first name and last initial and location by city or town, and state, will be posted at www.giftfromgodcomputerfoundation.org . If the selected winner is unable to be contacted or located after a period of forty (40) days from the draw date of any drawing, the prize or its cash equivalent will be deemed to have been donated to GFGCF for use by their charitable organization. All contact attempts shall be made to the mailing address and email address provided by the Drawing entry contributor. The winner, by entering, authorizes GFGCF to publish their name and likeness on the website and for it to be used in other promotional materials by GFGCF.
TAXES AND IRS RULES
All winners shall be responsible for any and all federal, state and local income or excise taxes, fees, assessments and like charges associated with the prizes. All cash prizes will be paid net of applicable income tax withholding. The IRS requires that income tax withholding on prize values of $5,100 or greater must be paid upon award and distribution. Government rules governing withholding can change without notice. The GFGCF Charity Drawing will follow the rules in effect at the time the prizes are awarded. The IRS has taken the position that amounts paid for chances to participate in Drawings, lotteries or similar programs are not gifts and, therefore, the price of the entry does not qualify as a deductible charitable contribution. Check with your qualified financial advisor for additional information.
WAIVER/LIMITATIONS OF LIABILITY
Entry donors, by participating (and winners, by accepting a prize) release The Gift From God Computer Foundation, and its respective board, committee members, volunteers, partners, vendors, agents, representatives, sponsors, service agencies and independent contractors, and each of their respective directors, officers, partners, employees and agents, including advertising, public relations, direct marketing and promotion agencies, from any and all liability with respect to participation in the promotion and possession or use of the prize(s) awarded and also acknowledge that they did not receive any representations, warranty or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition or fitness. Any liability of GFGCF shall be limited to ticket price paid and in the case of any dispute, GFGCF decision shall be final. GFGCF may at any time modify, revise, or update the Official Rules to correct any errors, omissions or changes to the Drawing, in its sole discretion. By participating in the Drawing you accept and are bound by its rules.
